Fair Usage Policy

This Fair Use Policy is intended to ensure the availability of the Services and Hardware to all eligible Natterbox customers (Clients) and that the Services are not used in an unreasonable manner.

1. Application

  1. This Fair Use Policy applies to Client’s usage of the Natterbox Unlimited Call Plans, such as Local Unlimited Plan, International Unlimited Plan, Unlimited Inbound Plan that form part of an unlimited call package pricing plan or promotional offer, AI Agents and any services that utilise call transcription.

  2. If Natterbox deems Client’s usage to be Unreasonable Use, then Natterbox will attempt to contact Client using the contact details provided by Client on the Client Sales Order. If Client is not responsive to Natterbox’s enquiries, or Client’s use continues to be Unreasonable Use, Natterbox may downgrade Client’s plan to the Variable Call Plan, modify Client’s Unlimited Call Plan,  limit the operational time of the affected AI system or suspend the Services.

  3. Client is liable for any additional fees, costs, expenses for additional User Subscriptions or AI system use fees at the then current variable per-minute or current rate.

  4. If applicable, Client hereby authorises Natterbox to charge Client’s credit card on file for such Fees. Natterbox may also terminate Client’s access to and use of the Services or modify the terms of the Service.

  5. Natterbox monitors AI Service usage to ensure fair access for all clients. Unusual patterns of usage that suggest automated or programmatic overutilization of AI Services may be flagged for review.

  6. Natterbox may implement technical measures to prevent excessive or abusive use of AI Services that could degrade service quality for other clients.

2. Fraudulent Use

Means resupplying or reselling a Service without Natterbox’ prior written consent so that someone else may access, use or commercially exploit the Services or Hardware.

3. Non-Ordinary Use

Means circumstances where Client makes or receives calls and/or makes use of the internet on the Natterbox System in any non-ordinary manner without obtaining Natterbox’s prior written consent, such consent may be reasonable withheld or subject to conditions at Natterbox’s discretion. Non-Ordinary Use also includes:

For fixed line services:

  1. Usage for operating a bulk, power-dialling or ‘robo-call’ business

  2. Usage with handsets, auto-dialler devices, software, or other equipment that have not been approved in writing by Natterbox for use on the System

For mobile services:

  1. Any use of a SIM Card in a SIM Box, GSM Gateway or any device that is used to automatically re-route calls

  2. Usage to menace, harass or injure any person or damage property

  3. Usage in connection with any infringement or violation of any applicable laws, regulations, or codes

  4. Any other activity which would be reasonably regarded as not ordinary use in relation to the Services and Hardware

For AI services:

  1. Systematic extraction of data, content, or training materials from AI Services

  2. Attempts to reverse-engineer, decompile, or otherwise discover the underlying models, algorithms, or training data of the AI Services

  3. Use of AI Services for developing competing AI technologies

  4. Automated or programmatic submission of repetitive queries or tasks to AI Services designed to extract maximum value beyond reasonable business use

  5. Use of AI Services in a manner that places excessive load on Natterbox systems, as determined by Natterbox in its reasonable discretion.

4. Unreasonable Use

Unreasonable Use” means where Client’s use of the Services and Hardware is considered by Natterbox to:

  1. Be Fraudulent Use

  2. Involve a Non-Ordinary Use

  3. Cause significant System congestion, disruption or otherwise adversely affect the System, or an Underlying Service Provider’s Network or Telecommunications Service Provider’s network

  4. Adversely affect another person’s use of or access to the Services or Hardware, the System, or an Underlying Service Provider’s Network or Telecommunications Service Provider’s network

  5. Link two or more communication devices together for the purposes of providing a permanent or semi-permanent circuit

  6. Involve wholesale use of any Service on the System

  7. Reroute calls to/from the System or the network of another Telecommunications Service Provider

  8. Use Natterbox Service for any other purpose than person-to-person voice communication

  9. Support activities such as, auto dialling, continuous or extensive call forwarding, use of virtual extensions for regular business use, continuous connectivity, fax broadcast, fax blasting, unlawful or unauthorised telemarketing, junk faxing, fax spamming, calling/faxing any person (through the use of distribution lists or otherwise) who has not given specific permission to be included in such a process

  10. Exceed a two minute average per voice call of AI-generated responses across a calendar month

5. WIFI Tethering

Unless specifically stated otherwise, Natterbox strongly discourages Client from tethering Client’s devices to a computer or other multimedia device as such tethering can result in excessive charges from carriers which will be passed on to the Client. It is recommended that wherever possible, Client use WIFI to connect a computer or multi-media device directly to the Internet for download.

6. Amendment

Natterbox may amend the terms of this Fair Use Policy at its discretion.
